Distance Selling Contract
This Agreement includes the sale-delivery of the following services to the BUYER, which the BUYER wishes to purchase by placing an order on the electronic commerce website www.specificit.com.au belonging to the SELLER, and regulates the rights and obligations of the parties in relation to other matters. After the BUYER approves this Agreement on www.specificit.com.au, the price and expenses of the service (s) ordered are collected by the payment method chosen.

Providing Web-design services, support and maintenance of the Websites as follows:A) Use templates:
There are specific pre-designed websites that buyers can choose each of them and by replacing the contents they want, they can have their website in the fastest possible time and with the lowest cost. In these cases, changes are limited to the features of the template, and therefore only minor changes in template, adding and decreasing the number of pages, content, images and color of the pages are possible.The specifications of these pre-designed templates and their prices are in accordance to the table 1.
B) Website design based on customer needs
In these cases, buyers can order the website without any restrictions according to their needs and tastes with the selected structure and formats. The cost of these websites shall be estimated case-by-case and notified to the buyer.C) Website support and maintenance services:
The buyer can sign a contract with us to maintain and support the website. These services include the following:- System updates (platform, plugins, widgets and softwares)
- Updating and changing information, images and website content
- Fixing the functional defects and website speed
- Fixing the defects in sending and receiving forms and emails from the website
- Optimizing and improving Database Servers
• Payment Terms and Delivery Conditions:
Payments and Delivery of Website to the buyer shall be through below phases:
Phase 1 – Data Collecting and Pre-payment:
At this phase the buyer shall purchase a Host, chose a Website template, provide all information, contents, photos, etc. as well as %30 pre-payment of the total price to us to start the project.Noted that it will not be possible to start the job until all of the above are provided to us by the buyer.
Phase 2 – Preview of the Website:
15 to 20 days after receiving the aforementioned information and the pre-payment from the buyer, a complete ‘Preview of the Website’ is provided to buyer for their review and corrections. This Preview contains all content, pages, photos and formats that the final version of the website will have. At this stage the buyer can ask for any changes and editions.By submitting the Preview to the buyer, the next %50 of the total agreed price shall be invoiced to the client to be settled into the SpecificIT account accordingly.
Note: Within 72 hours from pre-payment, E-mails are created and Outlook settings are informed to client; also, the Website can be visible under ‘Maintenance Mode’.
Phase 3 – Delivery of the Final Website:
The buyer has 10-15 days to inform us all required changes and editions on the Preview. The requested changes are finalized within 7-10 working days and then, the Final Website is submitted to the client to be launched.Then after the remained %20 of the total price is invoiced to the buyer for their settlement.
Phase 4 – Free Training, Maintenance and Support:
For the next 30 days after launching the final Website, we will provide free maintenance and support services to our buyers. This free service is limited to updating, editing of the contents/photos and maintenance of the Website. Any changes of the format, adding new pages and similar items are not included in this free service and have extra charges which shall be discussed and agreed by the buyer.The methods of updating content, adding and edditing data and similar items are being taught to the buyer through videos.
Phase 5 - Long-term support and maintenance services:
In case a buyer contract with SpecificIT for using long-term support and maintenance services, based on the buyer's request and need, website condition, how the service is used and type of the payment, the relevant fee is agreed between the parties, which can be as follows:A) Payment of a fixed monthly amount
B) Use support services on a case-by-case basis and SpecificIT provides an invoice after each step which amount depends on the work type and the time spent on doing it.
Note 1: Long-term support and maintenance services are available for all websites (designed by SpecificIT or other companies), but if the website is designed by SpecificIT, these services are provided with a 20% discount.
Note 2: If the buyer requests for changes that need separated redesigned, the cost will be calculated separately and after the agreement of the parties, will be considered.
Article 3- ISSUES THAT THE BUYER HAS BEEN INFORMED PREVIOUSLY
The BUYER acknowledges that he has been informed about the following issues by seeing and examining all the general-specific explanations in the relevant pages-sections of the SpecificIT SITE before the BUYER is established with the acceptance of this Agreement on the SpecificIT SITE and is under the obligation to pay and order- SELLER's title and contact information and up-to-date introductory information,
- The stages of the sales process during the purchase of the product (s) from the SpecificIT SITE and the appropriate tools-methods for correcting the wrongly entered information,
- Electronic contact information from the Vocational Chamber (ITO-Istanbul Chamber of Commerce) of which the SELLER is a member and ITO's code of conduct regarding the profession (Phone: 4440486, www.ito.org.tr)
- Confidentiality applicable to the BUYER information applied by the SELLER, data usage- processing and electronic communication rules to the BUYER and the permissions granted by the BUYER to the SELLER in these matters, the legal rights of the BUYER, the rights of the SELLER and the procedures for using the rights of the parties,
- The payment methods-means accepted by the SELLER for the services subject to the contract and the basic features and qualities of the service, the total price including taxes (the total price that the BUYER will pay to the SELLER including the related expenses),
- Information about the procedures for the delivery of the service to the BUYER
- Other payment and delivery information about the services and information on the execution of the Contract, the commitments and responsibilities of the parties in these matters,
Services for which the BUYER does not have the right of withdrawal,
- In cases where the BUYER has the right of withdrawal, the conditions, duration and procedure of using this right and the BUYER will lose the right of withdrawal in case the right is not used in time,
- According to its nature, all other terms of sale included in this Contract and since this Contract is approved by the BUYER on the SpecificIT SITE and sent to the BUYER by e-mail, it can be stored and accessed by the BUYER for a period of three years. can keep it with you,
- Transaction-applications about privacy, personal data and electronic commercial communications,
- In case of dispute, the BUYER may submit its complaints to the SELLER and make legal applications to District / Provincial Arbitration Committees and Consumer Courts in accordance with the relevant provisions of Law No. 6502.
- The BUYER has the right to withdraw from this Agreement and cancel the order without any justification and paying a penalty although he is required to fulfill his obligations in accordance with the Withdrawal and Refund Terms and Condition.
- For withdrawal, it is enough for the buyer to provide an explicit written notice to SpecificIT stating the cancellation of the order and requesting withdrawal from the contract (sending to the addresses mentioned above).
The legal rights and responsibilities of the BUYER regarding the Service after the withdrawal period and the rights and obligations of the SELLER, including the contractual and legal collection-offset rights
ARTICLE 4 - RULES REGARDING SECURITY-PRIVACY, PERSONAL DATA, ELECTRONIC COMMUNICATIONS AND INTELLECTUAL RIGHTS
In the SpecificIT SITE, the privacy rules-policy and conditions, the current principles of which are set forth below, are valid for the protection, confidentiality, processing-use and communications and other issues.4.1. The necessary precautions for the security of the information and transactions entered by the BUYER on the SpecificIT SITE are taken within the system infrastructure of the SELLER, within the scope of the current technical possibilities according to the nature of the information and transaction. However, since the information in question is entered from the BUYER device, it is the responsibility of the BUYER to take the necessary measures, including those related to viruses and similar harmful applications, in order to be protected by the BUYER and not to be accessed by unrelated persons.
4.2. In addition to the consent and approvals of the personal data and commercial electronic communications provided by the BUYER in other ways; Providing various services by the SELLER, the Group Companies, affiliates, partners, successors and / or third parties / organizations to be determined by the SELLER, the information obtained during the BUYER's membership and purchases to the SpecificIT SITE, and all kinds of information, advertisement-promotion, For electronic and other commercial-social communications to be made for communication, promotion, sales, marketing, credit card and membership applications, it can be recorded indefinitely or for a period to be foreseen by those and their successors, can be stored in printed / magnetic archives, updated when necessary can be shared, transferred, transferred, used and processed in other ways.
These data can also be transmitted to the relevant Authorities and Courts when required by law. The BUYER consents and gives permission for the use, sharing, processing and the making of non-commercial and non-commercial electronic communications and other communications, in accordance with the legislation on the protection of personal data and electronic commerce legislation, of its existing and new information.
4.3. The BUYER can always stop the communication by reaching the SELLER through the specified communication channels and / or accessing the data usage-processing and / or using the right of refusal in the electronic communications sent to him.
According to the BUYER's explicit notification on this matter, personal data transactions and / or communications to its party are suspended within the legal maximum period; In addition, if he / she wishes, his / her information other than legally required and / or possible shall be deleted from the data recording system or made anonymous in an anonymous way.
If the BUYER wishes, the transactions related to the processing of personal data, the persons to whom it is transferred, correction in case of incomplete or incorrect information, notification of the corrected information to the relevant third parties, deletion or destruction of the data, objection to the occurrence of a result against him by automatic systems, the data is against the law You can always apply to the SELLER through the above communication channels and get information on issues such as compensation in case of damage due to processing. Applications and requests regarding these issues will be fulfilled within the legal maximum periods or may not be accepted by explaining the legal justification to the party.
4.4. Regarding all kinds of information and content of the SpecificIT SITE and their arrangement, revision and partial / complete use; Except for those belonging to other third parties according to the SELLER's agreement; All intellectual and industrial rights and property rights belong to SpecificIT.
4.5. The SELLER reserves the right to make any changes it may deem necessary in the above matters; These changes will be valid from the moment they are announced by the SELLER on the SpecificIT SITE or through other appropriate methods.
4.6. The privacy-security policies and terms of use apply to other sites accessed through the SpecificIT SITE, and the SELLER is not responsible for any disputes and negative consequences that may occur.
Article 5- GENERAL PROVISIONS
5-1 The buyer must pay the price in accordance with the Payment Terms unless otherwise agreed with the seller. If the agreed price is not paid in full to the seller, the seller has the right to unilaterally cancel the contract and not deliver the website.5-2 If due to extraordinary circumstances (such as weather, earthquake, flood, fire) other than normal sale / delivery conditions, if it is not possible to deliver the website within the agreed period, the seller clearly informs the buyer about the delivery. In this case, the buyer can cancel the order or wait until the end of the disaster.
5-3 In order cancellations including contract-law withdrawals and contract termination, if the service price has been received, it will be returned to the BUYER within 14 days at most. The requirements of the following rule are reserved. The refund is made in accordance with the payment instrument used by the BUYER to pay the service price to the SELLER.
For example, in credit card payments, the refund process is also made by refund to the credit card of the BUYER and the Service amount is returned to the relevant bank within the same time after the order is canceled by the BUYER; Since the reflection of this amount to the BUYER’s account after the return of this amount to the bank is made by the SELLER is entirely related to the bank transaction process, the BUYER acknowledges in advance that it will not be possible for the SELLER to intervene and assume responsibility in any way for possible delays. (Banks' transactions to reflect the refund to the BUYER account can usually take up to three weeks).
The SELLER has the right of offsetting, discounting and deduction arising from this Agreement and the law for the amount to be refunded. The statutory rights of the BUYER are also reserved and available in cases where the contract is terminated by the BUYER due to the SELLER's failure to perform its performance.
5-4 The BUYER may notify the SELLER verbally or in writing about his requests and complaints regarding the service, by accessing the SELLER communication channels in the introduction part of the Contract
5-5 Some of the issues written in Article 3 above may not be included in this Agreement by nature; However, they are included in the Preliminary Information seen / approved by the BUYER on the SpecificIT SITE, as well as on the sales stages or general - information pages / sections of the SpecificIT SITE.
5-6 Since the BUYER is sent to the e-mail (mail) address provided after acceptance, the said Information and this Agreement can always be accessed and reviewed by saving and storing the said mail on its device. On the other hand, it is kept in the systems of the SELLER for three years.
5-7 The SELLER records (including magnetic media records such as computer-sound recordings) constitute evidence in resolving any dispute that may arise from this Agreement and / or its implementation; The rights of the parties arising from the relevant mandatory legal regulations are valid and reserved.
Article 6- LEGAL APPLICATION OF THE BUYER - AUTHORIZED JURISDICTIONS
In case of disputes that may arise from this Agreement, the Provincial and District Consumer Arbitration Committees within the monetary limits determined and announced each year by the Ministry of Customs and Trade, and in cases exceeding these limits, the Consumer Courts are in charge. Within this framework, the BUYER may apply to the Arbitration Committees and Consumer Courts in the SELLER's place of residence (residence).The BUYER has read all the conditions and explanations written in this Contract and in the order-contract preliminary information (SpecificIT SITE) that constitute its integral part, the SpecificIT basic features and qualities of the services subject to sale, sales price, payment method, delivery conditions, SELLER and all other preliminary information about the service subject to sale and the right of withdrawal, personal information, electronic communication including all matters written in Article 3 of this Agreement, that they have seen all of them electronically on the SpecificIT SITE and it accepts and declares that it accepts the provisions of this Agreement with the order of the service by giving confirmation-approval-acceptance-permission to all these in electronic environment.
Both the aforementioned preliminary notifications and this Contract are sent to the above e-mail address notified by the BUYER to the SELLER, and the confirmation that the order has been received is also included with the order summary in the said e-mail.

Aşama 3 - Nihai Web Sitesinin Teslimi:

Aşama 4 - Ücretsiz eğitim, bakım ve destek:
Nihai Web Sitesini başlattıktan sonraki 30 gün boyunca, alıcılarımıza ücretsiz bakım ve destek hizmetleri sağlayacağız. Bu ücretsiz hizmet, Web Sitesinin içeriklerinin / fotoğraflarının güncellenmesi, düzenlenmesi ve bakımı ile sınırlıdır. Biçimdeki herhangi bir değişiklik, yeni sayfalar ve benzer öğeler bu ücretsiz hizmete dahil değildir ve alıcı tarafından tartışılıp kabul edilecek ekstra ücretler söz konusudur.İçeriği güncelleme, veri ekleme ve düzenleme yöntemleri ve benzeri öğeler alıcıya videolar aracılığıyla öğretiliyor.
Aşama 5 - Uzun vadeli destek ve bakım hizmetleri:
Uzun vadeli destek ve bakım hizmetlerini kullanmak için SpecificIT ile alıcı sözleşmesi olması durumunda, alıcının talebi ve ihtiyacına, web sitesinin durumuna, hizmetin nasıl kullanıldığına ve ödeme şekline göre ilgili ücret taraflar arasında kararlaştırılır. aşağıdaki gibi olun:A) Sabit bir aylık tutarın ödenmesi
B) Destek hizmetlerini durum bazında kullanın ve SpecificIT, her adımdan sonra iş türüne ve bunu yapmak için harcanan zamana bağlı olan bir fatura sağlar.

Madde 3- ALICI'NIN ÖNCEDEN BİLGİLENDİRİLDİĞİ HUSUSLAR
ALICI, aşağıdaki hususlarda, bu Sözleşme'nin ALICI tarafından SpecificIT SİTESİ 'nde kabulü ile kurulmasından ve gerek siparişi, gerek ödeme yükümlülüğü altına girmesinden önce SpecificIT SİTESİ'nin ilgili sayfaları-kısımlarındaki tüm genel-özel açıklamaları görerek ve inceleyerek bilgilendiğini teyiden kabul eder.- SATICI'nın unvanı ve iletişim bilgileri ile güncel tanıtıcı bilgileri,
- Ürün(ler)'in SpecificIT SİTESİ'nden alınması sırasındaki satış işlemi aşamaları ile yanlış girilen bilgilerin düzeltilmesine ilişkin amaca uygun araçlar-yöntemler,
- SATICI'nın mensubu olduğu Meslek Odası (İTO-İstanbul Ticaret Odası) ve ITO'nun meslek ile ilgili öngördüğü davranış kuralları bilgisinin edinebileceği elektronik iletişim bilgileri (Telefon: 4440486, www.ito.org.tr)
- SATICI tarafından uygulanan ALICI bilgileri için geçerli gizlilik, veri kullanımı-işleme ve ALICI'ya elektronik iletişim kuralları ile ALICI'nın bu hususlarda SATICI'ya verdiği izinler, ALICI'nın kanuni hakları, SATICI'nın hakları ve tarafların haklarını kullanım usulleri,
- Sözleşme konusu Hizmetler için SATICI tarafından kabul edilen ödeme yöntem-araçları ile hizmetlerin temel özellik-nitelikleri, vergiler dahil toplam fiyatı (ilgili masraflar da dahil olmak üzereALICI'nın SATICI'ya ödeyeceği toplam bedel),
- Hizmet'in ALICI'ya teslimine ilişkin prosedürler hakkında bilgiler
- Hizmetler ile ilgili diğer ödeme ve teslimat bilgileri ile Sözleşme'nin ifasına ilişkin bilgiler, bu hususlarda tarafların taahhüt-sorumlulukları,
- ALICI'nın cayma hakkına sahip olmadığı hizmetler,
- ALICI'nın cayma hakkının olduğu durumlarda bu hakkını kullanma şartları, süresi ve usulü ile hakkın, süresinde kullanılmaması durumunda ALICI'nın cayma hakkını kaybedeceği,
- Mahiyetine göre bu Sözleşme'de de yer alan diğer tüm satış şartları ile işbu Sözleşme ALICI tarafından SpecificIT SİTESİ'nde onaylanarak kurulduktan sonra ALICI'ya elektronik posta ile gönderildiğinden ALICI tarafından istenen süre ile saklanıp buradan erişilebileceği, SATICI'nın da üç yıl süre ile nezdinde saklayabileceği,
- Gizlilik, kişisel veriler ve elektronik ticari iletişimler hakkında işlem-uygulamalar,
- Uyuşmazlık hallerinde ALICI'nın SATICI'ya şikayetlerini iletebileceği iletişim bilgileri ile yasal başvurularını 6502 Sayılı Kanun'un ilgili hükümlerine uygun olarak İlçe/İl Hakem Heyetlerine ve Tüketici Mahkemeleri'ne yapabileceği.
- ALICI, herhangi bir gerekçe göstermeksizin ve ceza ödemeksizin işbu Sözleşmeden cayma ve siparişi iptal etme hakkına sahiptir Çekilme ve Geri Ödeme Hüküm ve Koşullar uyarınca yükümlülüklerini yerine getirmesi gerekmesine rağmen
- Para çekme işlemi için alıcının SpecificIT'e siparişin iptal edildiğini ve sözleşmeden cayma talebini belirten açık bir yazılı bildirimde bulunması (yukarıda belirtilen adreslere gönderilmesi) yeterlidir.
ALICI'nın Hizmetler'e ilişkin cayma süresi sonrasındaki kanuni hakları-sorumlulukları ile SATICI'nın ALICI'dan olan, da kapsamak üzere akdi ve kanuni tahsil-mahsup hakları dahil hak ve yükümlülükleri ayrıca mevcut ve geçerlidir
MADDE 4 - GÜVENLİK-GİZLİLİK, KİŞİSEL BİLGİLER, ELEKTRONİK İLETİŞİMLER VE FİKRİ-SINAİ HAKLAR İLE İLGİLİ KURALLAR
SpecificIT SİTESİ'nde bilgilerin korunması, gizliliği, işlenmesi-kullanımı ve iletişimler ile diğer hususlarda aşağıda cari esasları belirtilen gizlilik kuralları-politikası ve şartlar geçerlidir4.1. ALICI tarafından SpecificIT SİTESİ'nde girilen bilgilerin ve işlemlerin güvenliği için gerekli önlemler, SATICI tarafındaki sistem altyapısında, bilgi ve işlemin mahiyetine göre günümüz teknik imkanları ölçüsünde alınmıştır. Bununla beraber, söz konusu bilgiler ALICI cihazından girildiğinden ALICI tarafında korunmaları ve ilgisiz kişilerce erişilememesi için, virüs ve benzeri zararlı uygulamalara ilişkin olanlar dahil, gerekli tedbirlerin alınması sorumluluğu ALICI'ya aittir.
4.2. ALICI'nın sair suretle verdiği kişisel veri ve ticari elektronik iletişimlerine dair izin-onaylarının yanısıra ve teyiden; ALICI'nın SpecificIT SİTESİ'ne üyeliği ve alışverişleri sırasında edinilen bilgileri SATICI, dahil olduğu Grup Şirketleri, bağlı şirketleri, ortakları, halefleri ve/veya bunların belirleyecekleri üçüncü kişiler/kuruluşlar tarafından muhtelif hizmetlerin sağlanması ve her türlü bilgilendirme, reklam-tanıtım, iletişim, promosyon, satış, pazarlama, kredi kartı ve üyelik uygulamaları amaçlı yapılacak elektronik ve diğer ticari-sosyal iletişimler için, belirtilenler ve halefleri nezdinde süresiz olarak veya öngörecekleri süre ile kayda alınabilir, basılı/manyetik arşivlerde saklanabilir, gerekli görülen hallerde güncellenebilir, paylaşılabilir, aktarılabilir, transfer edilebilir, kullanılabilir ve sair suretlerle işlenebilir. Bu veriler ayrıca kanunen gereken durumlarda ilgili Merci ve Mahkemelere iletilebilir.
ALICI kişisel olan-olmayan mevcut ve yeni bilgilerinin, kişisel verilerin korunması hakkında mevzuat ile elektronik ticaret mevzuatına uygun biçimde yukarıdaki kapsamda kullanımına, paylaşımına, işlenmesine ve kendisine ticari olan-olmayan elektronik iletişimler ve diğer iletişimler yapılmasına muvafakat ve izin vermiştir.
4.3. ALICI SATICI'ya belirtilen iletişim kanallarından ulaşarak veri kullanımı-işlenmelerini ve/veya aynı kanallardan ulaşarak ya da kendisine gönderilen elektronik iletişimlerdeki red hakkını kullanarak iletişimleri her zaman için durdurabilir.
ALICI'nın bu husustaki açık bildirimine göre, kişisel veri işlemleri ve/veya tarafına iletişimler yasal azami süre içinde durdurulur; ayrıca dilerse, hukuken muhafazası gerekenler ve/veya mümkün olanlar haricindeki bilgileri, veri kayıt sisteminden silinir ya da kimliği belli olmayacak biçimde anonim hale getirilir.
ALICI isterse kişisel verilerinin işlenmesi ile ilgili işlemler, aktarıldığı kişiler, eksik veya yanlış olması halinde düzeltilmesi, düzeltilen bilgilerin ilgili üçüncü kişilere bildirilmesi, verilerin silinmesi veya yok edilmesi, otomatik sistemler ile analiz edilmesi sureti ile kendisi aleyhine bir sonucun ortaya çıkmasına itiraz, verilerin kanuna aykırı olarak işlenmesi sebebi ile zarara uğrama halinde giderilmesi gibi konularda SATICI'ya her zaman yukarıdaki iletişim kanallarından başvurabilir ve bilgi alabilir. Bu hususlardaki başvuru ve talepleri yasal azami süreler içinde yerine getirilecek yahut hukuki gerekçesi tarafına açıklanarak kabul edilmeyebilecektir.
4.4. SpecificIT SİTESİ'ne ait her türlü bilgi ve içerik ile bunların düzenlenmesi, revizyonu ve kısmen/tamamen kullanımı konusunda; SATICI'nın anlaşmasına göre diğer üçüncü sahıslara ait olanlar hariç; tüm fikri-sınai haklar ve mülkiyet hakları SpecificIT'na aittir.
4.5. SATICI yukarıdaki konularda gerekli görebileceği her türlü değişikliği yapma hakkını saklı tutar; bu değişiklikler SATICI tarafından SpecificIT SİTESİ'nden veya diğer uygun yöntemler ile duyurulduğu andan itibaren geçerli olur.
4.6. SpecificIT SİTESİ'nden ulaşılan diğer sitelerde kendilerine ait gizlilik-güvenlik politikaları ve kullanım şartları geçerlidir, oluşabilecek ihtilaflar ile menfi neticelerinden SATICI sorumlu değildir.
Madde 5- GENEL HÜKÜMLER
5-1 Alıcı, satıcı ile aksi kararlaştırılmadıkça Ödeme Koşullarına uygun olarak fiyatı ödemek zorundadır. Satıcıya mutabık kalınan bedelin tamamının ödenmemesi halinde, satıcı sözleşmeyi tek taraflı olarak iptal etme ve web sitesini teslim etmeme hakkına sahiptir.5-2 Normal satış / teslimat koşulları dışında olağanüstü durumlar (hava durumu, deprem, su baskını, yangın gibi) nedeniyle, web sitesinin kararlaştırılan süre içinde teslim edilmesi mümkün değilse satıcı, alıcıya teslimatı açıkça bildirir. . Bu durumda alıcı siparişi iptal edebilir veya felaketin bitmesini bekleyebilir.
5-3 Sözleşme cayma ve sözleşme fesih dahil sipariş iptallerinde hizmet bedeli tahsil edilmiş ise en geç 14 gün içinde ALICI'ya iade edilir. Aşağıdaki kuralın gereksinimleri saklıdır. İade, ALICI'nın hizmet bedelini SATICI'ya ödemek için kullandığı ödeme aracına uygun olarak yapılır.
Örneğin Kredi kartlı ödemelerde iade işlemi de ALICI kredi kartına iade sureti ile yapılır ve hizmet tutarı, siparişin ALICI tarafından iptal edilmesinden sonra aynı sürede ilgili bankaya iade edilir; bu tutarın bankaya iadesi işleminin SATICI tarafından yapılmasında sonra ALICI hesaplarına yansıması tamamen banka işlem süreci ile ilgili olduğundan, ALICI olası gecikmeler için SATICI’nın herhangi bir şekilde müdahalesi ve sorumluluk üstlenmesinin mümkün olamayacağını şimdiden kabul eder (bankaların iadeyi ALICI hesabına yansıtma işlemleri genellikle üç haftayı bulabilmektedir).
SATICI'nın iade edilecek bedel için, bu Sözleşme ve kanundan doğan mahsup, indirim ve tenzilat hakları vardır ve saklıdır. Sözleşme'nin SATICI'nın edimini ifa etmemesinden ötürü ALICI tarafından feshedildiği hallere ilişkin ALICI kanuni hakları da saklı ve mevcuttur.
5-4 ALICI, Sözleşmenin giriş kısmında SATICI iletişim kanallarına ulaşarak, hizmete ilişkin istek ve şikayetlerini SATICI'ya sözlü veya yazılı olarak bildirebilir.
5-5 Yukarıda 3. maddede yazılı hususların bir kısmı mahiyeti itibari ile bu Sözleşme'de yer almayabilir; bununla beraber, ALICI tarafından SpecificIT SİTESİ'nde görülen/onaylanan Ön Bilgilendirmelerde, keza SpecificIT SİTESİ'nin --ilgisine göre satış aşamaları veya genel-- bilgilendirme sayfaları/bölümlerinde yer almaktadırlar
5-6 ALICI, kabulü sonrasında bildirdiği e-posta (mail) adresine gönderildiklerinden, söz konusu Bilgilendirmelere ve bu Sözleşme'ye, anılan maili cihazına kaydedip saklayarak her zaman ulaşabilir ve inceleyebilir. Öte yandan, SATICI nezdindeki sistemlerde üç yıl süre ile muhafaza edilir.
5-7 Bu Sözleşme'den ve/veya uygulanmasından doğabilecek her türlü uyuşmazlığın çözümünde SATICI kayıtları (bilgisayar-ses kayıtları gibi manyetik ortamdaki kayıtlar dahil) delil oluşturur; tarafların ilgili emredici yasal düzenlemelerden bu hususta doğan hakları geçerli ve saklıdır.
Madde 6- ALICI'NIN KANUNİ BAŞVURU YOLLARI - YETKİLİ YARGI MERCİLERİ
Bu Sözleşme'den doğabilecek uyuşmazlıklarda, Gümrük ve Ticaret Bakanlığı'nca yasa gereği her yıl belirlenen-ilan edilen parasal sınırlar dâhilinde İl ve İlçe Tüketici Hakem Heyetleri, bu sınırları aşan durumlarda Tüketici Mahkemeleri görevli-yetkilidir. ALICI, bu çerçevede, kendisinin veya dilerse SATICI'nın yerleşim yerindeki (ikametgahındaki) Hakem Heyetleri ve Tüketici Mahkemeleri'ne başvurabilir.ALICI, işbu Sözleşme'de yazılı tüm şartları ve açıklamaları ve ayrılmaz parçasını oluşturan sipariş-sözleşme ön bilgilerini (SpecificIT SİTESİ), satışa konu hizmetlerin SpecificIT temel özelliklerini ve niteliklerini, satış fiyatı, ödeme şeklini, SATICI ve satışa konu hizmet ile ilgili diğer tüm ön bilgiler ve cayma hakkı, kişisel bilgiler, elektronik iletişim, işbu Sözleşme'nin 3. maddesinde yazılı tüm hususlar da dahil olmak üzere elektronik ortamda SpecificIT SİTESİ üzerinde gördüklerini ve tüm bunlara elektronik ortamda teyit-onay-kabul-izin vererek işbu Sözleşme hükümlerini hizmet siparişi ile birlikte kabul ve beyan eder.
Gerek söz konusu ön bilgilendirmeler, gerek bu Sözleşme, ALICI'nın SATICI'ya bildirdiği yukarıdaki elektronik posta adresine de gönderilmekte, anılan elektronik postada siparişin alındığı teyidi sipariş özeti ile birlikte ayrıca yer almaktadır.
